BM Dumpster Rentals Terms of Service & Rental Agreement

Effective Date: October 31, 2026

These Terms of Service and Rental Agreement (“Terms”) govern dumpster rentals, junk removal services, and related services provided by BM Dumpster Rentals (“BM Dumpster Rentals,” “BM Dumpsters,” “we,” “us,” or “our”).

By placing an order, making payment, accepting these Terms during checkout, or allowing BM Dumpster Rentals to deliver equipment or perform services, the customer (“Customer,” “you,” or “your”) agrees to these Terms.

1. Rental Orders and Pricing

Pricing, dumpster size, included rental period, included weight allowance, delivery location, and other order-specific terms will be shown on the Customer’s quote, invoice, payment page, order confirmation, or other written communication from BM Dumpster Rentals.

Current standard pricing may vary by service area, material type, disposal requirements, rental duration, and other circumstances.

Unless otherwise stated in writing, quoted prices apply only to the services, rental period, weight allowance, and conditions specifically included in the Customer’s order.

2. Payment Authorization and Saved Payment Method

By providing a payment method and completing payment, the Customer authorizes BM Dumpster Rentals and its payment processor to store the Customer’s payment method for use in connection with the rental or service.

The Customer further authorizes BM Dumpster Rentals to charge the saved payment method for amounts legitimately incurred under this Rental Agreement, including, where applicable:

  • Excess weight or tonnage charges

  • Additional rental days

  • Additional pickups, swaps, or haul charges

  • Dry-run or trip charges

  • Relocation charges

  • Prohibited or restricted material charges

  • Disposal surcharges

  • Mattress, tire, appliance, or other special-item charges

  • Damage caused to BM Dumpster Rentals equipment

  • Cleaning charges resulting from prohibited or contaminated materials

  • Charges resulting from overloaded or improperly loaded dumpsters

  • Other charges specifically described in the Customer’s order or agreed to by the Customer

The Customer understands that some of these charges may not be known until after the dumpster is removed, weighed, emptied, inspected, or processed at a disposal facility.

BM Dumpster Rentals may process these additional charges after the initial rental payment without requiring the Customer to manually submit a second payment, provided the charge is authorized by these Terms or another agreement with the Customer.

BM Dumpster Rentals will make reasonable efforts to provide documentation or an explanation of additional charges, such as landfill weight tickets or disposal records, when applicable.

3. Weight Allowances and Tonnage Overage

Dumpster rentals may include a stated amount of disposal weight.

If the net disposal weight exceeds the included allowance, the Customer is responsible for the additional tonnage charge specified in the Customer’s order, quote, invoice, or applicable pricing.

For rentals subject to a $75 per ton overage rate, excess weight will be calculated based upon the disposal facility’s recorded weight.

Weight may be calculated proportionally rather than only in whole-ton increments.

Example: If a rental includes 2 tons and the disposal facility records 2.50 tons, the Customer may be charged for the additional 0.50 ton at the applicable overage rate.

The disposal facility’s scale ticket or other documented weight record will control in determining disposal weight unless there is an obvious error.

4. Rental Period and Additional Days

The rental period included with each order will be shown in the Customer’s quote, invoice, booking information, or other written communication.

The Customer must notify BM Dumpster Rentals when the dumpster is ready for pickup unless a pickup date has already been scheduled.

If a dumpster remains at the Customer’s location beyond the included rental period, additional daily or rental-period charges may apply.

BM Dumpster Rentals may charge the Customer’s saved payment method for authorized additional rental charges.

Availability for extended rentals is not guaranteed.

5. Dumpster Loading Requirements

The Customer is responsible for loading the dumpster safely and properly.

The Customer may not load the dumpster in a manner that creates an unsafe, overweight, unbalanced, or unlawful load.

BM Dumpster Rentals may refuse to transport a dumpster that cannot be safely or legally hauled.

If BM Dumpster Rentals cannot remove a dumpster because it is overloaded, overfilled, blocked, inaccessible, or unsafe to transport, the Customer may be responsible for additional trip, labor, unloading, or rental charges.

The Customer is responsible for removing excess material before pickup if requested.

6. Prohibited and Restricted Materials

Unless BM Dumpster Rentals gives prior written approval, Customers may not place hazardous, regulated, toxic, flammable, explosive, infectious, or otherwise prohibited materials into a dumpster.

Prohibited or restricted materials may include, depending on applicable disposal rules:

  • Paints and liquid chemicals

  • Fuels, oils, and solvents

  • Propane tanks or pressurized cylinders

  • Batteries

  • Medical or biological waste

  • Asbestos-containing materials

  • Hazardous chemicals

  • Pesticides

  • Explosives or ammunition

  • Hot ashes or burning materials

  • Wet concrete

  • Certain electronics

  • Refrigerants

  • Other materials prohibited by the receiving landfill, transfer station, or applicable law

Tires, mattresses, appliances, televisions, electronics, and other special disposal items may be accepted only subject to additional charges or prior approval.

The Customer is responsible for all charges, penalties, cleanup costs, disposal fees, damages, or other expenses resulting from prohibited materials placed in the dumpster.

7. Heavy Materials

Concrete, dirt, brick, block, roofing materials, asphalt, gravel, soil, and similar dense materials can create extremely heavy loads.

Customers must inform BM Dumpster Rentals before placing significant quantities of heavy materials into a dumpster.

BM Dumpster Rentals may establish special fill limits, weight restrictions, dumpster sizes, pricing, or disposal terms for heavy-material loads.

The Customer is responsible for charges associated with overweight loads or loads that must be partially unloaded before they can be safely transported.

8. Delivery Location and Property Conditions

The Customer is responsible for selecting an appropriate placement location.

BM Dumpster Rentals will make reasonable efforts to place dumpsters where requested but may refuse a requested location if our driver determines that placement would be unsafe or impractical.

The Customer represents that they have authority to authorize placement of the dumpster at the requested location.

The Customer is responsible for obtaining any required permits, approvals, homeowners association authorization, municipal permission, or other authorization required for placement.

9. Driveways, Pavement, Yards, and Property Damage

Dumpsters and roll-off trucks are heavy equipment.

Although BM Dumpster Rentals will exercise reasonable care, the Customer acknowledges that delivery and removal can potentially damage:

  • Asphalt

  • Concrete

  • Pavers

  • Gravel

  • Curbs

  • Sidewalks

  • Landscaping

  • Grass

  • Underground irrigation

  • Septic systems

  • Underground utilities

  • Other surfaces or property

By requesting placement, the Customer accepts the risk of ordinary surface damage associated with the placement and movement of heavy equipment.

The Customer should disclose weak pavement, septic systems, underground utilities, irrigation systems, freshly poured concrete, soft ground, or other conditions that may affect placement.

BM Dumpster Rentals is not responsible for damage caused by concealed conditions, inadequate surfaces, overloaded dumpsters, placement specifically requested by the Customer, or conditions outside BM Dumpster Rentals’ reasonable control.

Nothing in this section limits liability that cannot legally be waived.

10. Access to the Dumpster

The Customer must provide safe and unobstructed access for delivery, service, swaps, and pickup.

Vehicles, locked gates, construction materials, low-hanging wires, trees, equipment, or other obstacles must not prevent access.

If BM Dumpster Rentals arrives and cannot perform the scheduled service because access is unavailable, a dry-run or trip charge may apply.

11. Moving the Dumpster

Customers may not move, push, tow, lift, relocate, or otherwise reposition a dumpster without permission from BM Dumpster Rentals.

Damage caused by unauthorized movement may be charged to the Customer.

12. Damage to Equipment

The Customer is responsible for loss of or damage to BM Dumpster Rentals equipment occurring while the equipment is in the Customer’s possession or control, except for normal wear and tear or damage caused solely by BM Dumpster Rentals.

This may include damage caused by:

  • Fire

  • Paint

  • Chemicals

  • Heavy equipment

  • Unauthorized movement

  • Vandalism caused by conditions under the Customer’s control

  • Overloading

  • Improper loading

  • Prohibited materials

The Customer may be charged reasonable repair, cleaning, replacement, or recovery costs.

13. Delays and Service Availability

Delivery, pickup, and swap dates and times are estimates unless BM Dumpster Rentals specifically guarantees otherwise in writing.

Service may be delayed because of landfill delays, traffic, weather, mechanical problems, equipment availability, road conditions, emergencies, or other circumstances outside BM Dumpster Rentals’ reasonable control.

BM Dumpster Rentals will make reasonable efforts to communicate significant delays.

14. Cancellations

Cancellation and refund eligibility may depend on when the Customer cancels relative to the scheduled delivery or service.

Once a truck has been dispatched, equipment has been delivered, or substantial costs have been incurred in preparing the order, cancellation charges may apply.

Any order-specific cancellation policy provided to the Customer will control over this general provision.

15. Customer Responsibility for Contents

The Customer is responsible for all materials placed in the dumpster during the rental period, including materials placed into the dumpster by third parties.

Customers should secure or monitor the dumpster when necessary to prevent unauthorized dumping.

BM Dumpster Rentals is not responsible for unauthorized materials placed in the dumpster by third parties.

Any resulting disposal or overage charges remain associated with the rental unless otherwise agreed in writing.

16. Junk Removal Services

When BM Dumpster Rentals performs full-service junk removal, pricing may depend upon volume, weight, material type, labor requirements, accessibility, disposal costs, and other conditions.

The Customer represents that they own the property being removed or have authority to authorize its removal.

Once items are removed from the property, BM Dumpster Rentals may dispose of, recycle, donate, resell, or otherwise handle them at its discretion unless otherwise agreed in writing.

17. Chargebacks and Payment Disputes

Customers are encouraged to contact BM Dumpster Rentals before initiating a payment dispute so that we have an opportunity to investigate and resolve the issue.

If a Customer disputes a charge, BM Dumpster Rentals may provide the payment processor or financial institution with documentation related to the transaction, including:

  • The rental order

  • These accepted Terms

  • Payment records

  • Customer communications

  • Delivery and pickup records

  • Photographs

  • Disposal facility records

  • Scale tickets

  • Weight calculations

  • GPS or service records

  • Invoices

  • Other evidence relevant to the transaction

Nothing in this provision limits the Customer’s lawful rights to dispute unauthorized or incorrect charges.

18. Refunds

Refunds, credits, or adjustments may be issued at BM Dumpster Rentals’ discretion when appropriate and subject to applicable law.

Disposal charges, completed services, transportation costs, and other costs already incurred may be nonrefundable.

19. Limitation of Liability

To the fullest extent permitted by applicable law, BM Dumpster Rentals will not be liable for indirect, incidental, special, consequential, or punitive damages arising from a rental or service.

BM Dumpster Rentals’ liability for any claim arising from a specific rental or service will not exceed the amount paid by the Customer for that rental or service, except where applicable law requires otherwise.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

20. Indemnification

To the extent permitted by law, the Customer agrees to indemnify and hold BM Dumpster Rentals harmless from claims, penalties, costs, or expenses arising from:

  • Materials placed in the dumpster by the Customer or persons under the Customer’s control

  • Prohibited materials

  • Unauthorized placement of the dumpster

  • Customer violations of law or permit requirements

  • Unsafe site conditions not disclosed to BM Dumpster Rentals

  • The Customer’s breach of these Terms

21. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Any dispute will be handled in an appropriate court having jurisdiction over BM Dumpster Rentals and the transaction, unless applicable law requires otherwise.

22. Changes to These Terms

BM Dumpster Rentals may update these Terms periodically.

The Terms applicable to a transaction are the version in effect when the Customer places the applicable order or accepts the Terms.

23. Severability

If any portion of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.

24. Entire Agreement

These Terms, together with the Customer’s quote, invoice, payment page, booking confirmation, written communications, and any other order-specific terms, constitute the agreement between BM Dumpster Rentals and the Customer regarding the applicable rental or service.

If an order-specific written term conflicts with these general Terms, the order-specific term will control.
